Kalman & Associates provides clients with a broad range of services to help achieve and maintain compliance with environmental laws and regulations and, when necessary, successfully litigate environmental cases. We have a wealth of experience counseling clients on permitting and compliance issues arising under federal and state air quality, water quality, hazardous material, and solid waste management programs.

While litigation is an important part of our capability, we strive to help our clients avoid litigation by advising them on how best to comply with the law and structuring transactions to limit potential liabilities. When our clients face actual or potential environmental enforcement actions, we work with industry-leading technical consultants to assist them in structuring effective responses to Superfund and other agency and/or private enforcement actions, negotiating and developing plans to bring their operations into compliance, settle past violations, and minimize the risk of future liability.

Our attorneys have the necessary background and skills to handle the most complex regulatory regimes. We regularly assist clients in evaluating the numerous reporting obligations under federal environmental programs, including the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), Resource Conservation and Recovery Act (RCRA), Clean Water Act (CWA), Toxic Substances Control Act (TSCA), and the Emergency Planning Community Right-to-Know Act (EPCRA), as well as state reporting programs.

Over the years, our attorneys have established productive relationships with various federal, state, and local regulatory agencies, including the United States Environmental Protection Agency, New Jersey Department of Environmental Protection, New York State Department of Environmental Conservation, and Pennsylvania Department of Environmental Protection, and we draw on these relationships to quickly and efficiently resolve our clients’ most challenging regulatory compliance issues.
